   Polasaí Cosaint Leanaí  Gaelscoil Míde

 Is mian le hudaráis Ghaelscoil Míde go mbeidh an scoil ina thimpeallacht shabháilte do na daltaí agus don fhoireann. Tá sé mar chuspóir againn aire den chaighdeán is airde a sholáthar do na daltaí chun a leas a chinntiú agus iad a chosaint ó dhochar.

Tá an polasaí seo bunaithe ar na treoirlinte agus na modhanna oibre atá leagtha síos ag:

  • An Roinn Sláinte agus Leanaí – Children First – Treoirlínte Náisiúnta do Chosaint agus Leas Leanaí.
  • An Roinn Oideachais – Treoirlínte agus Cur Chuige um Chaomhnú Páistí
  • Lámhleabhar CPSMA 2004 – treoirlínte chun deileáil le mí-úsáid ghnéasach leanaí: aguisín 56: leathanaigh 195 – 203.
  • Ciorcalán 0094/2006 – An Roinn Oideachais agus Eolaíochta – Socruithe nua do sheiceáil foirne múinteoireachta agus daoine nach múinteoirí iad.
  • Ciorcalán 0065/2011 –An Roinn oideachais agus Scileanna –Nósanna Imeachta maidir le Caomhnú Leanaí i mBunscoileanna agis i Scoileanna Iarbhunscoile.

Is ceart d’fhoireann iomlán na scoile a bheith aireach agus má tá siad in amhras go bhfuil mí-úsáid á dhéanamh ar dhalta é sin a chur in iúl do Joe Ó Dónaill, príomhoide nó muna mbíonn seisean ar fáil, do Chaitlín Ní Mhuircheartaigh, príomhoide tánaisteach.

I ngach cás leanfar na Treoirlínte chun déileáil le liomhain nó amhras faoi mhí-úsáid atá leaghtha síos sa cháipéis Cosaint Leanaí, Treoirlínte agus cur chuige um Chaomhnú Páistí 2001.

Seiceáil: Daoine ar an Fhoireann agus Oibrithe Deonacha

Déanfar gach iarracht a chinntiú go bhfuil gach duine ar an fhoireann, agus oibrithe deonacha a bhíonn ag obair sa scoil ó am go chéile, oiriúnach le bheith ag obair le páistí.

Déanfar teastais gach iarrthóra do phost a iniúchadh agus rachaidh an príomhoide (nó cathaoirleach an Bhoird Bhainistíochta i gcás poist mar phríomhoide) i dteagmháil le fostóirí nó coláistí atá luaite.

Ní fhostófar aon duine má tá amhras ar bith nach bhfuil an duine sin oiriúnach le bheith ag obair le páistí.

 Polasaí um Chaomhnú Leanaí - Gaelscoil Míde (2015)

Glacann Bord Bainistíochta Ghaelscoil Míde leis go bhfuil fíorthábhacht le caomhnú leanaí agus leas leanaí maidir le gach gné de shaol na Gaelscoile agus nach mór sin a bheith le sonrú ar pholasaithe, modhanna oibre agus beartaíocht uile na Gaelscoile. Dá réir sin, ag teacht lena n-éilítear faoi Nósanna Imeachta maidir le Caomhnú Leanaí i mBunscoileanna agus i Scoileanna Iarbhunscoile (2011) na Roinne Oideachais & Scileanna (ar fáil ar líne ag: www.education.ie), tá an polasaí seo a leanas maidir le caomhnú leanaí aontaithe ag Bord Bainistíochta Ghaelscoil Míde.

Tá glactha ag an mBord Bainistíochta le Nósanna Imeachta maidir le Caomhnú Leanaí i mBunscoileanna agus i Scoileanna Iarbhunscoile (2011) na Roinne agus déanfar a gcur i bhfeidhm go hiomlán, gan athrú gan leasú, mar chuid den pholasaí ginearálta maidir le caomhnú leanaí. Tá foireann, tuismitheoirí agus bainistíocht Ghaelscoil Míde tar éis an polasaí seo ar chaomhnú leanaí atá ag teacht le nósanna imeachta thuas na Roinne Oideachais & Scileanna, agus na Roinne Leanaí & Gnóthaí Óige, a fhorbairt agus a ghlacadh. Pléann an polasaí seo le freagrachtaí na Gaelscoile sna réimsí seo a leanas:

  • -Caomhnú trí sholáthar churaclaim.
  • -Barrchleachtas um chaomhnú leanaí.
  • -Nósanna imeachta maidir le hábhair imní & nochtadh eolais.

Is iad na haidhmeanna atá ag an bpolasaí seo ná:

  • - Timpeallacht slán, iontaobhach, freagrúil agus comhbhách a chruthú
  • -Oideachas ar scileanna sábhailteachta pearsanta a dhíríonn go sainiúil ar chaomhnú leanaí a chur ar fáil do gach dalta sa Ghaelscoil.
  • -Feasacht agus freagracht ar chaomhnú leanaí a fhorbairt i measc phobal uile na Gaelscoile.
  • -Nósanna imeachta don dea-chleachtas a chothú chun na leanaí agus an fhoireann a chosaint.
  • -A dheimhniú go mbíonn eolas agus tuiscint ag foireann uile na Gaelscoile ar Nósanna Imeachta maidir le Caomhnú Leanaí i mBunscoileanna agus i Scoileanna Iarbhunscoile (2011) na Roinne Oideachais & Scileanna, agus ar Tús Áite do Leanaí: Treoir Náisiúnta um Chosaint agus Leas Leanaí (2011)ón Roinn Leanaí & Gnóthaí Óige (ar fáil ar líne ag: www.dcya.ie ), agus go háirithe ar na treoracha agus na nósanna imeachta cuí a luaitear iontu sin maidir le himní nó nochtadh eolais faoi dhrochúsáid leanaí a chur in iúl.

I ndáil le polasaithe, modhanna oibre agus beartaíocht de chuid Gaelscoil Míde cloífear leis na prionsabail seo a leanas den dea-chleachtas maidir le caomhnú agus leas leanaí:

Déanfaidh an Ghaelscoil:

  • glacadh leis go bhfuil fíorthábhacht le caomhnú leanaí agus leas leanaí, tar éis gach taobh den scéal a chur san aireamh;
  • comhoibriú go hiomlán leis na húdaráis chuí faoin reachtaíocht maidir le caomhnú leanaí agus cúrsaí leasa leanaí;
  • gnásanna sábháilte a ghlacadh chuici féin d'fhonn an dóigh go dtarlódh dochar nó tionóisc do leanbh a mhaolú oiread agus is féidir agus an lucht oibre a chosaint ó chall dul i mbaol nach gá a bhféadfadh gurb é toradh a bheadh air go gcuirfí drochúsáid nó faillí ina leith;
  • gnás ionracais a thabhairt chun cinn le tuismitheoirí agus iad a spreagadh a bheith rannpháirteach in oideachas a gcuid leanaí;
  • meas iomlán a léiriú ar riachtanais rúndachta agus í ag déileáil le cúrsaí caomhnaithe leanaí.

Caomhnú trí sholáthar churaclaim – an cleachtas reatha (2015)

Is iad na cláir Bí Sábháilte, Misneach agus Oideachas Caidrimh & Gnéasachta (OCG), na príomhfhoinsí a bhíonn in úsáid sa Ghaelscoil chun oideachas a chur ar dhaltaí maidir le caomhnú ó dhrochúsáid. Tá na cláir seo á múineadh mar chuid de churaclam Oideachas Sóisialta Pearsanta & Sláinte (OSPS) na Gaelscoile faoin tsnáithe Sábháilteacht & Cosaint (Sábháilteacht Phearsanta).

 Barrchleachtas um chaomhnú leanaí
Aithníonn foireann agus Bord Bainistíochta na Gaelscoile iad seo a leanas mar réimsí a bhfuil gá faoi leith ag baint leo maidir le caomhnú leanaí. Tá na nithe seo leanas go háirithe aitheanta tar éis comhphlé le tuismitheoirí, an fhoireann agus an Bord Bainistíochta:


a) Teagmháil fhisiceach: Ní dhéantar teagmháil fhisiceach le daltaí ach amháin nuair is gá, m.s. chun sábháilteacht dalta / páiste eile / an mhúinteora a chinntiú.
b) Cuairteoirí / Aoichainteoirí: Den chuid is mó, is iad na baill foirne a mhúinfidh na cúrsaí OSPS, ach ó am go h-am, is ceadmhach daoine seachtracha oiriúnacha a thógáil isteach sa Ghaelscoil chun labhairt le na daltaí, ach an Príomhoide a bheith ar an eolas faoi seo roimh ré.
c) Leanaí ag a bhfuil cúnamh leithris /riachtanais cúram pearsanta: Fágtar seo faoin múinteoir ranga i gcomhairle le tuismitheoirí an dalta agus an cúntóir riachtanas speisialta (CRS).
d) Timpistí leithris: Tá stoc d’éadaí breise glana sa stóras. Má tá dalta trí chéile cuirfear fios ar thuismitheoir.
e) Teagasc aonarach (duine le duine), srl: Níl sé inmholta do mhúinteoir / teagascóir / duine proifisiúnta seachtrach, srl, a bheith ina (h)aonar le dalta i seomra leis an doras dúnta. Ní mór an Príomhoide a chur ar an eolas faoi aon athrú ón dea-chleachtas seo.
f) Éadaí a athrú do Chluichí/ Corpoideachas/ Snámh: Athraítear éadaí sna seomraí gléasta cuí. Ní ceadmhach do mhúinteoir / teagascóir bheith sna seomraí gléasta seo le dalta aonarach.
g) Earcú agus roghnú foirne: Cuirtear scéim ghrinnfhiosrúcháin an Gharda Síochána (An Biúró Náisiúnta Grinnfhiosrúcháin) i bhfeidhm nuair atá baill nua foirne á n-earcú.
h) Cuirtear an scéim chéanna ghrinnfhiosrúcháin an Gharda Síochána (An Biúró Náisiúnta Grinnfhiosrúcháin) i bhfeidhm maidir le gach duine seachtrach (tuismitheoirí nó deonaithe, srl.) atá i dteagmháil le daltaí de chuid na Gaelscoile agus iad ag cuidiú le himeachtaí laistigh nó lasmuigh den Ghaelscoil, gan múinteoir a bheith i láthair.
i) Iompar ginearálta: Tá Cód Iompair i bhfeidhm sa Ghaelscoil.
j) Feitheoireacht na ndaltaí: Déanfar gach iarracht réasúnta len a chinntiú go mbíonn múinteoir i gcónaí ag déanamh feitheoireachta ar na daltaí.
k) Úsáid idirlín: Tá Polasaí Úsáid Inghlactha don Idirlíon ag an nGaelscoil.

Cé go ndéanfar gach iarracht cloí leis an gcleachtas is fearr, de réir mar a leagtar amach thuas, má tharlaíonn i gcás éigin (neamhghnách nó eisceachtúil) nach mbíonn sé indéanta ná praiticiúil an dea-chleachtas thuasluaite a chur i bhfeidhm ba chóir don mhúinteoir (agus/nó aosach eile) cuntas iomlán d’aon eachtra den tsórt a scríobh agus a chur in iúl don Phríomhoide gan aon mhoill.

Éilíonn an Bord ar gach múinteoir seasamh i gcónaí leis na caighdeáin proifisiúnta riachtanacha agus daingníonn sé anseo na gnéithe seo a leanas, ach go háirithe, ó An Cód Iompair Ghairmiúil do Mhúinteoirí (2012) ó An Chomhairle Mhúinteoireachta:

Ba chóir do mhúinteoirí gach céim réasúnta a ghlacadh maidir le cúram dalta atá faoina maoirseoireacht, chun a sábháilteacht agus a leas a chinntiú.

Ba chóir do mhúinteoirí cloí le polasaithe, le nósanna imeachta agus le treoirlínte a bhíonn comhaontaithe go náisiúnta agus ag leibhéal scoile a mbíonn sé mar chuspóir acu oideachas agus leas na ndaltaí, mar aon le cosaint páistí, a chur chun cinn.

Ba chóir do mhúinteoirí tuairisciú, más cuí, ar eachtraí agus ar chúinsí a théann i bhfeidhm ar leas daltaí.

Cleachtas Gairmiúil

Ba chóir do mhúinteoirí gníomhú ar mhaithe le leas is fearr na ndaltaí.

Tá brath ag an mBord go gcloífidh gach fostaí eile agus daoine seachtracha atá sa Ghaelscoil leis na caighdeáin proifisiúnta céanna mar a éilítear ar gach múinteoir ag An Chomhairle Mhúinteoireachta.

 Nósanna imeachta maidir le hábhair imní & nochtadh eolais
Leanfaidh an fhoireann go léir (múinteoirí, cúntóirí riachtanas speisialta (CRS), foireann tacaíochta, rúnaíochta, feighlíochta, srl.) sa Ghaelscoil na treoracha don tuairisciú ar ábhair imní nó ar nochtadh eolais mar atá luaite i Nósanna Imeachta maidir le Caomhnú Leanaí i mBunscoileanna agus i Scoileanna Iarbhunscoile (2011) na Roinne Oideachais & Scileanna, agus Tús Áite do Leanaí: Treoir Náisiúnta um Chosaint agus Leas Leanaí (2011) ón Roinn Leanaí & Gnóthaí Óige.

 Ba chóir d’aon duine, (tuismitheoir, ball foirne, srl.) a bhfuil aon bhuairt, imní nó ábhar amhrais faoi leith air/uirthi ó thaobh chaomhnú dalta an bhuairt nó an imní sin a chur in iúl don DIA nó Leas- DIA. Déanfaidh an DIA agus an Leas-DIA aon ábhar imní a iniúchadh agus a scagadh de réir treoracha na Ranna thuasluaite. Glacfar na céimeanna cuí dá réir sin ina dhiaidh.

Tuismitheoirí & cúramóirí a chur ar an eolas
Ba chóir don DIA atá ag cur tuairisce faoi bhráid FSS nó an Gharda Síochána é sin a chur in iúl freisin do thuismitheoir / cúramóir murar dócha gurbh ionann déanamh amhlaidh agus an dalta a chur i gcontúirt nó a chur i mbaol breise. Coinneofar taifead scríofa ar an eolas a chuirtear in iúl don tuismitheoir / cúramóir. Coinneofar taifead achomair scríofa ar shocrú nach gcuirfear in iúl do thuismitheoir / cúramóir go bhfuil tuairisc á tabhairt maraon le taifead ar na cúiseanna leis an socrú sin.

Maidir le cás faoi liamhaint nó ábhar amhrais i leith fostaí nó deonaí seachtrach sa Ghaelscoil is den riachtanas é go bpléifí leis an gcás faoin rúndacht is déine agus nach nochtfaí ainm an duine sin ag an bpointe luath seo. D’fhéadfadh an Bord treoir breise, faoin ngné seo, a thabhairt don bPríomhoide (DIA) má’s gá san.

Líomhaintí nó ábhar amhrais maidir le fostaithe de chuid na Gaelscoile faoi dhrochúsáid a thabhairt ar leanbh
Déanfaidh an Bord Bainistíochta tagairt faoi leith do na forálacha i gCaibidil 5 de Nósanna Imeachta maidir le Caomhnú Leanaí i mBunscoileanna agus i Scoileanna Iarbhunscoile (2011) ón Roinn Oideachais & Scileanna nuair atá sé ag déileáil lena leithéid de tharluithe. Tabharfaidh an Cathaoirleach agus an Príomhoide éifeacht iomlán ar bhealach tráthúil do na forálacha sainráite atá leagtha amach in alt 5.4, "An beart atá le déanamh ag an bhfostóir", agus go háirithe, suntas a dhéanamh de fho-alt 5.4.3 a chuireann iachall ar an bhfostóir cóip den taifead scríofa agus/nó den líomhain i scríbhinn, maille le haon cháipéisíocht eile a bhaineann le hábhar na líomhana, a thabhairt go díreach don fhostaí. Ba chóir é seo a dhéanamh chomh luath agus is féidir agus pé scéal é roimh aon chruinniú nó cruinnithe den Bhord Bainistíochta a bheadh ag déileáil leis an gcás. Sa mhéid seo, is cuma cé uaidh a dtagann an tuairisc chuig an Ghaelscoil - tuismitheoir, dalta, fostaí eile, srl, nó fiú ó Fheidhmeannacht na Seirbhísí Sláinte (FSS).

Ghlac an Bord Bainistíochta le Prótacal ar leith lena dtugtar údarás don Chathaoirleach i leith beart láithreach, má éigníonn na cúinsí é. Tá an Prótacal sonrach sin curtha mar Aguisín leis an bpolasaí seo.

 Baineann ailt 5.2, "Prótacal lena dtugtar údarás le beart láithreach", agus 5.4, "An beart atá le déanamh ag an bhfostóir", leis an ní a thabhairt láithreach faoi bhráid chruinnithe den Bhord Bainistíochta. Mar aon leo siúd, baineann ailt 5.5, "Aon bhearta breise a bheadh de dhíth", agus 5.6, "Aiseolas ó Fheidhmeannacht na Seirbhísí Sláinte" (FSS), leis an mBord ag déileáil leis an gceist faoi thodhchaí fhadtéarmach an fhostaí tar éis don FSS an Bord a chur ar an eolas faoi thoradh an mheasúnaithe/imscrúdúcháin. Ar eagla aon amhrais, caithfidh an Cathaoirleach agus an Príomhoide a chinntiú go gcuirtear an fostaí ar an eolas i gceart faoin gcruinniú den Bhord atá ag teacht agus go bhfaigheann sé/sí cuireadh chun freastal ar an gcruinniú, agus bheith i láthair nuair atá gach eolas faoin gcás á thabhairt do bhaill an Bhoird. Is féidir leis an bhfostaí duine/daoine oiriúnach(a) a bheith in éineacht leis/léi mar chuidiú nó chun ionadaíocht a dhéanamh ar a s(h)on. In ainneoin an chirt atá ag an bhfostaí duine a bheith i láthair chun cuntas cruinn beacht a dhéanamh ar an gcuid sin den chruinniú ag a bhfuil an fostaí i láthair cuirfidh an Bord cóip de na miontuairiscí ar fáil dó/di chomh fada agus a bhaineann siad leis an gcás. Ní mór taifead a bheith sna miontuairiscí de theideal, údar agus dáta gach doiciméad a cuireadh faoi bhráid an chruinnithe. Beidh an nós imeachta seo thuas i bhfeidhm i dtaca le gach cruinniú den Bhord ag a ndéantar tagairt don chás.

 Scaipfidh an Príomhoide fótachóipeanna de na doiciméid seo a leanas ar gach ball den Bhord sula gcuirfear tús le céad chruinniú an Bhoird a luaitear thuas:

  • - Caibidil 5 de Nósanna Imeachta maidir le Caomhnú Leanaí i mBunscoileanna agus i Scoileanna Iarbhunscoile (2011) a bhaineann le liamhaintí maidir le fostaithe scoile.
  • - Cóip den Polasaí um Chaomhnú Leanaí - Gaelscoil Míde (2013) seo, ina bhfuil cóip den Phrótacal lena dtugtar údarás le beart láithreach mar atá glactha ag an mBord.

Foinsí gaolmhara
Tá eolas breise ar fáil ó na foinsí seo a leanas a d’fhéadfadh a bheith úsáideach do bhaill na foirne agus iad ag cur an Pholasaí seo i bhfeidhm:

(a) An Snáithaonad Sábháilteacht & Cosaint (Sábháilteacht Phearsanta) sa chlár OSPS i gCuraclam na mBunscoileanna
(b) An Cód Iompair – Gaelscoil Míde
(c) An Polasaí Frith-Bhulaíochta – Gaelscoil Míde

(d) An Polasaí Úsáide Inghlactha don Idirlíon – Gaelscoil Míde
(e) An Ráiteas Sábháilteachta – Gaelscoil Míde

Tá sé cinntithe ag an mBord go bhfuil na polasaithe, prótacail nó cleachtais, de réir mar is cuí, curtha i bhfeidhm i ndáil le gach ceann de na rudaí thuasluaite.

 Cuireadh an polasaí seo ar fáil do fhoireann na Gaelscoile agus do Choiste na dTuismitheoirí agus tá sé ar fáil go héasca ag tuismitheoirí ach cóip de a iarraidh sa Ghaelscoil í féin.Mar aon le sin, cuirfear cóipeanna de Nósanna Imeachta maidir le Caomhnú Leanaí i mBunscoileanna agus i Scoileanna Iarbhunscoile (2011) agus Tús Áite do Leanaí: Treoir Náisiúnta um Chosaint agus Leas Leanaí (2011) ar fáil do gach ball foirne. Tá sé mar dhualgas ar gach ball foirne é/í féin a chur ar an eolas maidir leis na treoracha is na nósanna imeachta san agus cloí leo dá réir. Cuirfear cóip den pholasaí seo ar fáil don Roinn Oideachais & Scileanna agus don phátrún sa chás go n-iarrtar é.

 Déanfaidh an Bord Bainistíochta an polasaí seo a thabhairt faoi athbhreithniú ó am go chéile sna blianta amach anseo. Fáilteofar roimh moltaí ina leith ó éinne ag aon am.

 Prótacal lena dtugtar údarás le beart láithreach

 

Ghlac  Bord Bainistíochta  Ghaelscoil Míde leis an bPrótacal seo a leanas ag a chruinniú i mí Deireadh Fómhair 2013 agus go gcuirfí é mar Aguisín leis an Polasaí um Chaomhnú Leanaí - Gaelscoil Míde (2013).

  1. Tabharfar cuireadh don fhostaí teacht chuig cruinniú le Cathaoirleach an Bhord Bainistíochta arb é an cuspóir a bheidh leis an fostaí a chur ar an eolas faoin líomhain, muna bhfuil sé seo déanta cheana féin ag an bPríomhoide, agus faoi aon chéim atá á ghlacadh ag an bpoinnte sin. Tig leis an bPríomhoide a bheith i láthair ag an gcruinniú seo, má fheileann san. Is féidir leis an bhfostaí duine/daoine oiriúnach(a) dá rogha féin a bheith in éineacht leis/léi agus cuirfear sin in iúl dó/di roimh ré.
  2. Cuirfear, ar aon chuma, an fostaí go hiomlán ar an eolas faoin gcás i scríbhinn chomh luath agus is féidir.
  3. I gcomhthéacs na nósanna imeachta seo, má éigníonn na cúinsí é mar bheart riachtanach réamhchúraim d'fhonn leanaí na Gaelscoile a chaomhnú agus de réir phrionsabail an cheartais aiceanta agus toimhde na neamhchiontachta, tá údarás bronnta ag an mBord Bainistíochta ar an gCathaoirleach ordú do fhostaí fanacht ón am sin díreach as láthair na Gaelscoile gan aon chaillteanas pá go dtí go mbíonn an cheist measta ag an mBord. Is den ríthábhacht a thabhairt chun aire gur bearta réamhchúraim a gcuirtear síos orthu anseo agus nach bearta araíonacha iad. Cloífear leis na prionsabail de chothrom na Féinne i ngach déileáil leis an bhfostaí.
  4. Sula mbaineann an Cathaoirleach leas as an bPrótacal seo molann an Bord dó/di dul i gcomhairle leis an bPríomhoide agus freisin, díríonn an Bord aird an Chathaoirligh agus an Phríomhoide ar na forálacha in ailt 4.4.2 & 5.4.5 i Nósanna Imeachta maidir le Caomhnú Leanaí i mBunscoileanna agus i Scoileanna Iarbhunscoile (2011):

Child Protection Policy

Gaelscoil Míde

The authorities of Gaelscoil Míde wish, and firmly resolve, that the school will be a safe environment for pupils and staff.  It is our aim to provide the pupils with the highest possible standard of care in order to promote their well-being and protect them from harm.

This policy follows the guidelines and procedures laid down by the:

  • Department of Health and Children – Children First, National Guidelines for the Protection and Welfare of Children, 1999.
  • Department of Education – Child Protection, Guidelines and Procedures, 2001
  • The CPSMA Handbook 2004 – Guidelines for dealing with child sexual abuse: appendix 56; page 195 – 203
  • Department of Education and Science Circular 0094/2006 - Arrangements for the vetting of teaching and non teaching staff.
  • Department of Education and Skills Circular 0065/2011 child Protection Procedures for Primary and Post-Primary schools.

All school personnel will be expected to be vigilant and where they suspect abuse or negligence they should report such concerns to the Designated Liaison Person i.e. Joe Ó Dónaill, príomhoide, or if he is unavailable to Caitlín Ní Mhuircheartaigh, príomhoide tánaisteach.

In all cases the guidelines for dealing with allegations or suspicions of child abuse as laid down by the Child Protection, Guidelines and Procedures, 2001 will be followed.


Vetting of Staff and Volunteers
Every effort will be made to make sure that all staff and volunteers are suitable to work with children.  Their previous employers or college will be contacted by the principal (or the chairperson of the Board of Management in the case of the position of Principal) and all references will be followed up.
No person will be employed if there is any doubt or suspicion that the person is unsuitable to work with children.

 Child Protection Policy - Gaelscoil Míde (2015)


 The Board of Management recognises that child protection and welfare considerations permeate all aspects of life in Gaelscoil Míde and must be reflected in all of the Gaelscoil’s policies, practices and activities. Accordingly, in accordance with the requirements of the Child Protection Procedures for Primary and Post Primary Schools (2011) of the Department of Education & Skills (available on line at:www.education.ie ) the Board of Management of Gaelscoil Míde has agreed the following child protection policy.

 The Board of Management has adopted and will implement fully and without modification the Department’s Child Protection Procedures for Primary and Post Primary Schools (2011) as part of this overall child protection policy. The staff, parents and management of Gaelscoil Míde have developed and agreed this policy on child protection which is in keeping with the above procedures of the Department of Education & Skills, and of the Department of Children & Youth Affairs. This policy deals with Gaelscoil Míde’s responsibilities in the following areas:

  • - Protection through curricular provision.
  • - Best practice for child protection.
  • - Procedures with regard to grounds for concern & disclosure of information ( Item 8 ).

 The following are the aims of this policy:

  • - To create a safe, trusting, responsible and empathic environment.
  • - To provide education on personal safety skills that is directed specifically towards child protection to every child in the Gaelscoil.
  • - To develop awareness and responsibility on child protection among the entire Gaelscoil community.
  • - To promote procedures around best practice to protect the children and the staff.
  • - To ensure that the entire Gaelscoil Míde staff has an awareness and understanding of the Child Protection Procedures for Primary and Post Primary Schools (2011) of the Department of Education & Skills, and of the Children First: National Guidance for the Protection and Welfare of Children (2011) of the Department of Children & Youth Affairs (available on line at:www.dcya.ie), and in particular, about the guidance and appropriate procedures mentioned in them as regards making known anxiousness or disclosures concerning child abuse.
  • - To provide ongoing training to the staff in this area.

In its policies, practices and activities, Gaelscoil Míde will adhere to the following principles of best practice in child protection and welfare:

Gaelscoil Míde will:

• recognise that the protection and welfare of children is of paramount importance, having had due regard for all other considerations;

• fully co-operate with the relevant statutory authorities in relation to child protection and welfare matters;

• adopt safe practices to minimise the possibility of harm or accidents happening to children and protect workers from the necessity to take unnecessary risks that may leave themselves open to accusations of abuse or neglect;

• develop a practice of openness with parents and encourage parental involvement in the education of their children;

• fully respect confidentiality requirements in dealing with child protection matters.

 Protection through curricular provision – the current practice (2015)

The main sources for educating children about child protection in the Gaelscoil are the Stay Safe, Walk Tall and Relationships & Sexuality Education (RSE) programmes. These programmes are taught as part of the Gaelscoil’s Social Personal & Health Education (SPHE) curriculum under the strand Safety & Protection (Personal Safety).

Best practice for child protection

The staff and Board of Management recognise the following as areas with particular requirements concerning child protection. The following in particular have been identified, following consultation with the staff, the parents and the Board of Management:

a) Physical contact: Physical contact is not made with children except when it is necessary, e.g. to ensure the safety of a pupil / another child / the teacher.

b) Visitors / Guest speakers: In general, the teaching staff will deliver the SPHEcourses, but from time to time, it is permissible to bring in suitable external advisors to the Gaelscoil to speak to the children, as long as the Principal (Príomhoide) is aware of this beforehand.

c) Children with toileting requirements / personal care requirements: This area is the responsibility of the class teacher in consultation with the child’s parents and the special needs assistant (SNA).

d) Toileting accidents: A supply of spare clean clothes is kept in the storeroom. If a child is upset, a parent will be contacted.

e) Individual teaching (one-to-one), etc: It is not advisable for a teacher / instructor / external professional, etc, to be on his/her own with a child in a room with the door closed. The Príomhoide (Principal) should be made aware of any departure from this good practice.

f) Clothes changing for Games / Physical Education / Swimming:   Children change in the appropriate changing rooms. It is not permissible for a teacher / instructor to be in these changing rooms with an individual child.

g) Recruitment and selection of staff: The Garda (National Vetting Bureau) vetting system will be employed when new staff members are being recruited

h) All external persons (parents or volunteers, etc) who are in contact with the Gaelscoil’s children while assisting with activities within or outside of the Gaelscoil, where no teacher is present, will be subject to the same Garda (National Vetting Bureau) vetting system.

i)General behaviour: Gaelscoil Míde has a Code of Behaviour in place.

j)Supervision of the children: Every reasonable effort will be made to ensure that there is always a teacher supervising the children.

k)Internet use:   Gaelscoil Míde has an Acceptable Usage Policy for the Internet in place.

 

Even though every effort will be made to adhere to best practice, as set out above, if it happens in a particular case (unusual or exceptional) that it is not possible or practical to adhere to the best practice above, the teacher (and/or other adult) should write a full account of any such incident and inform the Principal (Príomhoide) without any delay.

 The Board requires all teachers to uphold the requisite professional standards at all times and it further affirms here the following aspects, in particular, of the Code of Professional Conduct for Teachers (2012) of The Teaching Council :

 

Professional Conduct

3.2    Teachers should take all reasonable steps in relation to the care of pupils under their supervision, so as to ensure their safety and welfare.

3.4    Teachers should comply with agreed national and school policies, procedures and guidelines which aim to promote pupil education and welfare and child protection.

3.5    Teachers should report, where appropriate, incidents or matters which impact on pupil welfare.

4.   Professional Practice

4.8    Teachers should act in the best interest of pupils.

The Board expects all other employees and external personnel who are in the Gaelscoil to adhere to the same professional standards as are required of all teachers by The Teaching Council.

Procedures with regard to grounds for concern & disclosure of information         

The entire staff (teachers, special needs assistants (SNA), support staff, secretarial and caretaking staff, etc.) will follow the directions for reporting grounds for concern & disclosure of information contained in the Child Protection Procedures for Primary and Post Primary Schools (2011) of the Department of Education & Skills, and in the Children First: National Guidance for the Protection and Welfare of Children (2011) of the Department of Children & Youth Affairs.

 Any person (parent, member of staff, etc.) with any particular concern, worry or suspicion regarding child protection should inform the DLP or Deputy DLP. The DLP and Deputy DLP will examine and assess any cause for concern in accordance with the Department’s guidance referred to above. The appropriate steps will be taken accordingly thereafter.

 Informing parents and carers

Where the DLP is submitting a report to the HSE or An Garda Síochána he/she should inform a parent / carer unless doing so is likely to endanger the child or place the child at further risk. A written record shall be made of the information communicated to the parent / carer. A decision not to inform a parent / carer that a report is being submitted shall be briefly recorded in writing together with the reasons for not doing so.

In the case of an allegation or suspicion regarding an employee or other volunteer in the Gaelscoil it is essential that at all times the matter is treated in the strictest confidence and that the identity of that person shall not be disclosed at this initial point. The Board may give additional directions, regarding this aspect, to the Principal (DLP) if necessary.

Allegations or suspicions of child abuse regarding employees of the Gaelscoil

The Board of Management of Gaelscoil Míde will make particular reference to the provisions in Chapter 5 of the Child Protection Procedures for Primary and Post-Primary Schools (2011) from the Department of Education & Skills when it is dealing with such events. The Chairperson & Principal will give full effect in a timely manner to the express provisions which are laid out in section 5.4,  “Action to be taken by the employer”, and in particular, to take account of sub-section 5.4.3 which compels the employer to give a copy of the written record and/or allegation and any other related documentation directly to the employee. This should be done as soon as possible and in any case prior to any meeting or meetings of the Board which would be dealing with the case. In this regard, it is immaterial from what source the report is communicated to the Gaelscoil - parent, pupil, another employee, etc, or even from the Health Service Executive (HSE).

 The Board of Management has approved a specific Protocol authorising immediate action by the Chairperson (Cathaoirleach), should circumstances warrant it. The detailed Protocol is attached to this policy as an Appendix.

 Sections 5.2,  “Protocol authorising immediate action”, and 5.4,  “Action to be taken by the employer”, relate to the matter being brought to the immediate attention of the full Board of Management, whereas sections 5.5,  “Further follow-up required”  and 5.6,  “Feedback from the Health Service Executive”, relate to the Board dealing with the question of the future position of the employee after the HSE has informed the Board of the outcome of its assessment/investigation. For the avoidance of any doubt, the Chairperson and the Principal must ensure that the employee is informed properly of any upcoming meeting of the Board and to ensure that he/she is invited to such meetings, and to be present when all information about the case is being presented to the Board members. The employee may bring an appropriate person or persons to the meeting to assist or to represent him/her. Notwithstanding the employee’s right to have someone attend in order to make an accurate written account of that part of the meeting at which the employee is present, the Board will furnish the employee with all minutes which pertain to the case. The minutes will record the title, author and date of each document that has been put before the meeting. The above procedure will apply for every meeting of the Board which makes reference to the case.

 

The Principal will distribute to each member of the Board photocopies of the following policy documents prior to the start of the initial meeting of the Board referred to above:

 -          Chapter 5 of the Child Protection Procedures for Primary and Post-Primary Schools (2011) which relates to allegations regarding school employees.

 -          A copy of this Child Protection Policy - Gaelscoil Míde (2013), which includes a copy of the Protocol authorising immediate action as adopted by the Board.

Additionally, copies of the Child Protection Procedures for Primary and Post Primary Schools (2011) of the Department of Education & Skills, and the Children First: National Guidance for the Protection and Welfare of Children (2011) of the Department of Children & Youth Affairs will be made available to every member of staff. Each staff member has the responsibility to inform themselves about the guidance and those practices and to adhere to them accordingly. A copy of this policy will be made available to the Department of Education & Skills and to the patron if requested.

The Board of Management will review this policy from time to time in future years. Suggestions will be welcomed from any person at any time.

Appendix

Protocol  Authorising  Immediate  Action

 

The Board of Management, Gaelscoil Míde approved the following Protocol at its meeting in October 2013 and that it is to be added as an Appendix to the Child Protection Policy  -  Gaelscoil Míde  (2013).

  1. The employee will be invited to a meeting with the Chairperson (Cathaoirleach) of the Board of Management, the purpose of which is to inform the employee of the allegation, if not already done by the Principal (Príomhoide), and of the action now being taken at that point. The Principal (Príomhoide) may also attend at that meeting, if appropriate. The employee may be accompanied by an appropriate person(s) of his or her choice and will be so advised beforehand.
  2. In any event, the employee will also be advised fully of the matter in writing as soon as possible.
  3. In the context of these procedures, where the circumstances warrant it as a necessary precautionary measure in order to protect the children in the Gaelscoil and in accordance with the principles of natural justice and the presumption of innocence, the Chairperson is authorised by the Board of Management to direct an employee to immediately absent himself/herself from the Gaelscoil without loss of pay until the matter has been considered by the Board. It is very important to note that the actions described here are intended to be precautionary and not disciplinary. The principles of fair procedures shall be adhered to in all dealings with the employee.
  4. Prior to the Chairperson invoking this Protocol the Board advises him/her to liaise with the Principal and further, the Board directs the attention of the Chairperson and Principal to the provisions in sections 4.4.2 & 5.4.5 in the Child Protection Procedures for Primary and Post-Primary Schools (2011):


 4.4.2     Every HSE Local Health Office area has a designated person with responsibility for co-ordinating child protection services. These personnel are responsible for:

(a)      receiving all notifications of child abuse;

(b)      taking decisions relating to the holding of child protection conferences;

(c)      ensuring interagency co-operation on child welfare and protection;

(d)      ensuring interprofessional and interprogramme co-operation on child protection and welfare;

(e)      overseeing staff training programmes;

(f)      negotiating service agreements with voluntary service providers.

Once a report of suspected child abuse or neglect has been made to the HSE, it is then a matter for the HSE to decide upon the action, if any, which is necessitated by that report. The social worker handling the case may need to seek further clarification from the person who first raised the concerns.  In some cases, the response of the HSE will be to call a child protection conference.”

5.4.5     Where the employer is unsure as to whether the nature of the allegation warrants the absence of the employee from the school while the matter is being investigated, the employer shall consult with the HSE and/or An Garda Síochána for advice as to the action that those authorities would consider necessary. Following those consultations, the employer shall have due regard to the advice offered.  If, in the opinion of the employer, the nature of the allegation warrants immediate action or the ratification of action taken under the protocol referred to in section 5.2 above, the employer shall direct that the employee absent himself/herself from the school with immediate effect. The principles of natural justice and fair procedures shall be applied.”

5.Where the Chairperson and/or Principal decides to seek such a recommendation from the HSE and, in particular, as to:  Whether or not the HSE considers that the circumstances are such as to necessitate that the employee be directed to be absent from the Gaelscoil pending the outcome of the investigation by the HSE, the Board strongly advises that the above specific request be made in writing (by registered letter) by the Principal to the Child Care Manager and that a signed written reply be obtained from the HSE setting out its recommendation regarding this specific question. Copies of that correspondence are to be given to the employee as soon as possible. The Board also strongly advises that all related correspondence should issue from the Principal and/or Chairperson, even where legal advice has been obtained to assist with the wording of those letters, and that all such correspondence be addressed to the Child Care Manager in person.

6.Where this Protocol is invoked to absent an employee from the Gaelscoil an emergency meeting of the Board of Management shall be convened as soon as possible thereafter. The employee is to be invited toattend. Copies of any such correspondence with the HSE are to be distributed to the members of the Board at that emergency meeting and to the employee himself/herself in advance of it.

7. The Chairperson is is requested to have a written report available for that emergency meeting setting out the details of the above actions.

Notes:

All policies of Gaelscoil Míde are subject to a process of review & amendment from time to time. The Parents Association (Comhairle na dTuismitheoirí) and the teaching staff are consulted in this process before a new or revised policy is finally adopted by the Board of Management.

All of the Gaelscoil’s policies are drawn up in both English & Irish.  In the event that some difference is noted between the two versions of any policy a parent, etc, may choose to rely on either version as being the more beneficial for their child or their needs generally.  The Board conducts its meetings through Irish but it will deal with any matter through either Irish or English as requested by any parent or other person.
